Facebook and Jury Voir Dire in New Jersey

September 12, 2010

I recently blogged on why jurors should not post to Facebook about the trial.  I then suggested that attorneys might take to researching jurors’ profiles.

Well, lawyers in New Jersey now have a court of appeal’s permission to do just that during voir dire.

Courtooms in NJ have WiFi, and a few attorneys have taken to Googling jurors during the voir dire process.  One trial judge ordered an attorney to disconnect from the Internet to keep him from gaining an advantage.

An appeals court ruling, however, has overturned his order, allowing attorneys to use the Internet to research jurors.

Law.com has more explanation.
